Dr. Chandra Shekhar is a Partner with the firm and brings to the firm over 19 years of experience. He obtained the degree in LLB. from Campus Law Centre, Faculty of Law, University of Delhi, the then, premier Law School in India and was enrolled with the Bar Council of Delhi in year 1997. Prior to attaining his law degree he pursued his Bachelors in Commerce from same University.

Later on he did his LL.M (Masters of Law) from same University. As a part of curriculum he submitted dissertation on "Fundamental Right to Free and Compulsory Primary Education in India" on which a law was passed later on by carrying out an amendment in the Constitution of India. In year 2008, he was awarded the degree of Doctorate in Law from University of Delhi for his Doctoral thesis on "Structure of Human Rights in Developing Countries with special reference to India".

As an additional qualification, he also holds a Diploma in French language from University of Delhi. and Certificate Course in Information Technology from Indian Law Institute, New Delhi, 2007.

Dr. Shekhar has keen interest in academics, besides professional work and in past he has taught Law both at LL. B. and LL. M level. at various central universities including University of Delhi and Jamia Millia Islamia, research institutes including Indian Law Institute, V. V. Giri National Labor Institute and Institute of Constitutional and Parliamentary Studies. He has also delivered lectures at Bhartiya Vidyapeeth Deemed University, Amity Law School Delhi, Amity Law School, Noida etc on various subjects of law. Has been specially invited by Khatmandu School of Law at Khatmandu at Nepal for delivering the Lectures at 3rd Winter Residential School on Economic, Social and Development Rights and Good Governance - 2006. In this the law students from South Asian Countries participated. At presently also he is invited from time to time to deliver the law lectures by various law institutes of international repute. Subjects taught by him includes Civil Procedure Code, Criminal Procedure Code, Human Rights, Constitutional Law, Law of Arbitration, Law of Limitation, Corporate Management, Techniques of Judicial Control, Environmental law, Labour Laws, Intellectual Property Rights Laws, Testamentary and Intestate Succession, Banking Laws, Taxation laws and Laws relating to Registration of properties. etc.

He represented India in the capacity of Researcher on the project, Developing Rights based approach for anti - Trafficking Actions in South Asia, a project assigned by Terre Des Hommes, NGO.

He has also presented research papers at various National and International Seminars, Conferences, etc. The research papers include Continuing Legal Education, Human Rights and Democracy etc. The book reviews written by him have been published in journals of international repute.

Very recently he was specially invited to judge the semi - final rounds of "The Louis M. Brown and FSM International Client Consultation Competition 2013"  India Chapter. He has also been invited specially by Institute of "Constitutional and Parliamentary Studies to deliver special lectures on Fundamental Rights under Indian Constitution and Inter - State trade and commerce as a part of curriculum for Parliamentary Fellows.

Before joining India Law Offices Dr. Shekhar has served as a panel lawyer for various organizations including Central Govt, PSUs and private sector as well. As a panel lawyer he served State bank of India, Kotak Mahindra Bank, Delhi State Cooperative Bank, Food Corporation of India and Delhi High Court Legal Services committee.

In the year 2003, he was appointed as a Panel Lawyer of Delhi High Court Legal Services Committee. As a panel lawyer dealt with various civil and criminal matters, including matrimonial matters, Writ Petitions against Central and State Govt addressing the grievances of citizens against violation of Fundamental Rights, Recovery matters, Intellectual Property Rights issues, Arbitration matters, labour and service matters. He gave both advisory opinions on the issues involved in abovementioned law subjects as well as defended the rights of the parties before Courts.

In the year 2004, His Excellency the President of India was pleased to appoint him Panel lawyer for Central Government for representing the Union of India/Central Govt, in various matters before High Court of Delhi. As a Panel lawyer he represented the Union of India in several matters, wherein Union of India was inpleaded as a party. In particular dealt with Service and labour Matters, issues relating to compensation wherein the Fundamental Rights of the Citizens are said to have been violated and other related matters. The empanelment was initially for a period of two years and after reviewing the performance, it was again extended for a period of another two years. (Total duration - 2004-2008).

 

Dr. Chandra Shekhar, since last 19 years has been engaged in extensive litigation and is experienced in practicing before Hon'ble Supreme Court of India, High Courts, Districts Courts, Consumer Forums, Debt Recovery Tribunals, Debt Recovery Appellate Tribunal, Company Law Board, Arbitral Tribunals, and other quasi judicial bodies etc. He has widely traveled throughout India and appeared before various High Courts, District Courts and Tribunals.

In particularly he deals with Writ Petitions, against government and semi government institutions covering service and labour matters and other matters wherein the interpretation of constitutional issues are involved. He has represented government as well as private litigants before High Court and Supreme Court in Writ Petitions. He also has an experience in handling Letters Patent Appeal before the High Court against the decision passed by Single Bench of High Court in Writ Jurisdiction. He has handled Recovery Suits, Recovery of Debts by Banks and Financial Institutions before Debt Recovery Tribunal and Debt Recovery Appellate Tribunal, Securitization Appeals, Arbitration Matters, Disputes relating to Property matters including family disputes, Registration and drafting of title documents, Title search of documents, Civil Revisions and Appeals against the Trial Court Orders, Company Matters including Winding - Up Petitions, matters before Company Law Board, Company Appeals before the Division Bench of High Court, Matters relating to deficiency in goods and services, before consumer Forums at State Level, National Level and District level, Testamentary Jurisdiction matters, Criminal revision petitions, Petitions relating to quashing of FIR, Bail matters and other criminal matters, Special Leave Petitions before Hon'ble Supreme Court of India. Advisory opinions on Service and labour Matters, interpretation of Constitutional provisions, various issues involved on Civil Procedure Code and Criminal Procedure Code, Arbitration related issues, advisory opinion on recovery under Securitization Act and related issues, disputes involving child labour, Matrimonial matters, Inter and Intra country Adoptions. Execution Petitions and also attended Mediation Proceedings and the proceedings before Lok Adalats.

Dr. Shekhar has several times been appointed as Local Commissioner, Court Receiver for conducting local investigation in matters pertaining to Intellectual Property Rights, Property Disputes etc. He has also been appointed as Chairperson and Alternate Chairperson by Company Court, High Court of Delhi for conducting the meetings of Shareholders and Creditors, in matters relating to Amalgamation.

Currently with India Law Offices, he is handling the litigation and advisory opinions as well. In particular, he looks after Institutional Arbitration, International Commercial Arbitration etc. Assisting the clients in drafting the contracts containing arbitration clause, advisory opinion in appointment of Arbitrator by the parties at dispute, filing the petitions before Court in appointment of arbitrators as per the terms of the contracts entered into between the parties. Execution of Arbitral Awards passed by Indian Arbitral Tribunal and Foreign Arbitral Tribunal in Indian courts. And execution of awards passed by Arbitral Award at Foreign Courts. Handling Objection Petitions against the arbitral award and Arbitration appeals.

  • He has experience in research work for issues relating to litigation as well as corporate matters. Providing various legal opinions relating to Testamentary Jurisdiction, Intellectual Property Rights matters and related issues. Matrimonial, Labour and service, Child adoption both inter and intra country adoptions, Immigration related issues, Admiralty jurisdictions, insurance claims, Surrogacy matters etc.
  • He has a vast experience of drafting Suit Petitions for Recovery Matters, matters relating to intellectual Property Rights, disputes relating to property matters, Writ Petitions against Govt and semi - Govt. institutions and Public bodies, Appeals in both civil as well as criminal matters, Complaints to be filed before the Consumer Forums, Special Leave Petitions, drafting of evidence and briefing the client for evidence. He is also having an enough exposure in Drafting Sale Deed, Lease deed, vetting and drafting of corporate agreements like Franchise agreements, tripartite agreements, Appointment letters, Non - disclosure agreements, drafting of agreements for clients.

  • On the Criminal side, experienced in bail, quashing petitions before the High Courts, complaints before police stations, assisting the Public Prosecutors on behalf of the victims in criminal proceedings. Providing services at all forums, right from trial court to Supreme Court including specialized cells such as Crime Against Women Cell, Enforcement directorate, Vigilance commissioner, Anti Piracy Cell etc.
  • In insurance sector, assisting both domestic and foreign clients on the aspect of claims under various insurance policies, drafting and vetting of Insurance policies etc. as well as advisory opinion on international and domestic law relating to carriage of goods including advisory opinion on Customs Act, carriage of goods etc.
  • Apart from the above mentioned aspects of services, constantly engaged in providing the services before Mediation and Conciliations cell at various courts, assisting the clients in proceedings before Lok Adalat etc.
  • On behalf of the firm, in last few years he has assisted national and foreign banks in recovery related issues, enforcement of foreign decrees obtained against defaulters/borrowers, execution of arbitral award at Domestic level and international level against the Arbitral award passed by Arbitral Tribunal. Assisting the corporate houses by drafting and vetting the appointment letters for their human resource, relieving letters and other related issues. Assisted the Diplomatic clients including Algerian embassy in vetting the contract for guarding services contract labour and regulation, Safety measures for employees, Standard uniforms for employees, Legal opinion on various issues relating to Factories Act, vetting of lease agreements, drafting and vetting of appointment letters, drafts of pleadings & representation in litigation matters and drafting of Warehousing agreements, Legal Opinion on the issues relating to transport of goods through shipping. Drafted and vetted Lease Agreements, Non - Disclosure agreements, Consultant agreements. Advised international clients on the issues relating to exercise of right of subrogation as per Indian laws. Drafting of agreements for clients having a business in Hospital administration, Old age homes etc.
  • As any good litigator, he has a thorough knowledge of procedural laws, including the Code of Civil Procedure, code of criminal procedure and evidence. His knowledge in above fields is outstanding. Personal laws is a field he enjoys, be it matters relating to adoption, partition of properties, succession laws, marriage and divorce, guardianship, maintenance and so on. He is having a thorough knowledge on both Public and Private international law, which plays a key role in issues relating to personal laws.

Cases for deficiency in goods and services under the provisions of Consumer Protection Act, 1986 including Medical Negligence cases. Cases of cheque bounce under the Negotiable Instruments Act, 1881. Family disputes related to partition, possession and declaration under various Acts.
